Is an OnlyFans or MYM agency legal?
Yes, as long as it sells a management and marketing service, not the content itself. What protects it: a clear management contract, the creator's written consent for each use of her image, and written rules for chatters who write in her name.
What is the criminal exposure of an OFM agency?
The offences aimed at anyone who arranges or profits from another person's prostitution: pandering and FOSTA-SESTA in the United States, sections 52 and 53 of the Sexual Offences Act 2003 in the United Kingdom. Selling lawful recorded or streamed content is not prostitution; arranging paid in-person meetings is. An agency that sticks to marketing, account management and fan relations, backed by a contract and evidence, protects itself; one that imposes content or meetings does not.
How do I avoid my creators or chatters being reclassified as employees?
By removing anything that looks like subordination: imposed hours, total exclusivity, sanctions, tools supplied with no consideration. The contract has to describe a real independent service, and day-to-day practice has to match.
What commission can an agency take?
The law sets no cap: in a dispute, the judge reads the contract. A high commission is defensible if the service is real and documented (marketing, chatting, management). A commission on income the agency did not generate, or exclusivity with no time limit, weakens the whole contract.
Which structure should an OFM agency use?
It depends on your country of residence, your payout volume and your exit plans. A local company is fine to start; a holding with a foreign subsidiary becomes useful above a certain volume or if you relocate.
Which bank accepts an OnlyFans agency?
Few mainstream banks. Several institutions and EMIs accept these flows, in Europe and beyond, if the file is clean: clear structure, signed contracts, documented source of funds. We prepare it and know whom to present it to.
